"Waqf Board Bill 2025 : Proposed Amendments and Their Implications"

Waqf Board Bill refers to the legislative provisions relating to the management and regulation of Waqf properties in India. Under which a property is permanently dedicated to the Waqf Board for religious or philanthropic purposes. It was established in India in 1995. The Waqf Act, 1995 is in force to regulate the matters related to Waqf in India, which has been amended from time to time. Today this Waqf Board Bill was again introduced by the Government of India in the Lok Sabha for amendment and passed in the Lok Sabha. Tomorrow it will be introduced in the Rajya Sabha and then after passing in the Rajya Sabha, it will become a law after the President's signature. 

Waqf Board 1995 Rules

According to the rules of the Waqf Board, a Waqf Board is formed in every state, which manages the Waqf properties. And will take care of them. Registration of all waqf properties will be mandatory. Without registration, these properties will be considered illegal.  Apart from this, the board will also ensure that there is no illegal occupation of Waqf properties. Waqf tribunal has been arranged to settle disputes related to the board. Appeals can be made there on disputes related to Waqf Board properties. Income from Waqf properties will be used in education, social welfare and religious works.

After the formation of Waqf Board in 1955, amendments were made in it from time to time.

First Amendment 2013 

The first amendment was made in 2013. Under this amendment, rules were made stricter to protect Waqf properties and the powers of Waqf Board were increased as compared to earlier. This amendment was made in 2013 during the Congress government when Manmohan Singh was the Prime Minister. The main objective of this amendment was to stop illegal occupation and eliminate corruption and to improve the efficiency and transparency of Waqf Board and to digitally monitor its properties.

Proposed Second Amendment 2 April 2025: 

Today on 2 April 2025, the Waqf Bill was passed in the Lok Sabha. Three main changes have been made in it as compared to earlier. 

1. The Waqf Board has the Central Waqf Council and the State Waqf Council. All its members come from the Muslim community. It is proposed to include non-Muslim members in it. Diversity and transparency will increase in the management of the board.

 2. Whatever disputed waqf properties are there. It is proposed to give the government the right to decide on the ownership of the property. So that the relations of ownership of the properties can be resolved.

 3. Currently, Section 40 in the Waqf Board Act, which gives the Waqf Board the right to declare any property as waqf property. It is proposed to remove it. By removing it, there will be transparency in declaring the properties as the property of the waqf board and justice will be ensured.

Does this Waqf Board exist in other countries as well ? 

Waqf Board exists not only in India but all over the world. This Waqf Board is functioning in many Islamic countries Saudi Arabia, UAE , IRAN and non-Islamic countries BRITAIN, AMERICA. In these countries, Waqf properties are used for the education, health and religious purposes of the poor. In some countries, it is under the control of the government. And in some countries, this board operates independently. The United Nations and international organizations also recognize this board.

Conclusion 

The Waqf Board is working for the management and social welfare of Waqf properties in India. This board, established under the Act of 1995, is proposed to be amended in 2013 and 2025. This amendment proposes to include non-Muslim members, allow government decision on disputed properties and remove Section 40. In the coming time, this proposed Waqf Board Bill has been passed in the Lok Sabha. While passing in the Lok Sabha, BJP's allies JDU and TDP supported it. And the opposition Congress, SP etc. opposed the formation of this law. Tomorrow this bill will be presented in the Rajya Sabha and then after passing in the Rajya Sabha, it will go to the President. After the President's signature, it will take the form of a law. What shortcomings and challenges will there be after it becomes a law is a matter of time to come.how it will impact society, government and the stakeholders of waqf properties.
